Licensing & Disclosures

What Provenance Capital is, what it isn't, and how our data may be used. Last updated: August 3, 2026.

Provenance Capital is a data and research service. We compile and sell New York City commercial property and mortgage information drawn from public records. We are not a lender, mortgage broker, real estate broker, or consumer reporting agency. We do not originate, fund, broker, negotiate, or advise on loans, and our data is not a “consumer report.”

What we provide

Provenance Capital sells two things: datasets of NYC commercial mortgages approaching their maturity window (delivered as a working file), and single-property intelligence reports. Both are compiled from New York City public records — the Department of Finance ACRIS database, the Department of City Planning PLUTO dataset, and DOF valuations — via the NYC Open Data API. We also publish an informational lender directory and educational guides.

Our role begins and ends with providing that information. We do not:

  • make, fund, originate, or service loans;
  • negotiate, or offer or attempt to negotiate, the terms of any loan;
  • solicit, process, place, or negotiate a residential mortgage loan;
  • take a loan application or collect a borrower's application-level financial information;
  • advise you on which loan, lender, property, or transaction to choose;
  • act as any lender's or owner's agent, or bind anyone to any rate, term, or approval.

Not a consumer report

Our data and reports describe properties and their public transaction record, and business-entity owners. They are not“consumer reports” as defined by the federal Fair Credit Reporting Act (FCRA), and Provenance Capital is not a consumer reporting agency.

You may not use our data or reports, in whole or in part, as a factor in establishing any individual's eligibility for credit, insurance, employment, housing or tenancy, or for any other purpose permissible under the FCRA. We withhold individual (natural-person) owner names — we surface business-entity owners and the properties themselves. By purchasing, you agree not to use what you buy for any FCRA-covered purpose.

Sources & accuracy

Everything we sell is compiled from public records via the NYC Open Data API. Estimated maturity windows and unused development rights are modeled indicators — not confirmed maturities, balances, payoffs, or appraisals. Figures are as accurate as the underlying public record and our estimates; verify against the source records before relying on them for any decision.

Your use of the data

You are responsible for how you use what you buy. Any outreach you conduct to owners you find is governed by the Telephone Consumer Protection Act (TCPA), the National Do-Not-Call Registry, CAN-SPAM, and applicable New York law. Data compiled from public records does notcarry marketing consent, and calls or texts carry different obligations than direct mail. Do not use the data unlawfully, to harass, or in violation of any third party's rights.

Licensing position

Selling information compiled from public records is not licensed mortgage or real-estate activity. Our scope is designed to sit outside New York's mortgage-licensing regimes:

Banking Law Article 12-D (NYS DFS)

DFS registers mortgage brokers who solicit, process, place, or negotiate residential mortgage loans (Banking Law §590). We do none of those things — we sell data — so we do not engage in activity covered by Article 12-D.

Real Property Law Article 12-A, §440 (NYS DOS)

New York's real estate broker definition reaches a person who, for a fee, negotiates or offers or attempts to negotiate a non-residential mortgage loan. We do not negotiate, or offer or attempt to negotiate, any loan, and we are not compensated in connection with any loan or transaction.

If our activities change — if we begin negotiating loans, taking applications, providing consumer reports, or accepting compensation tied to a loan or transaction — this analysis no longer holds, and the applicable registration or licensure would be required first.

The lender directory

Our lender profiles are editorial reference content, compiled from public and lender-published sources. A listing is not a paid advertisement, is not an endorsement, and does not imply that the lender pays us or has any relationship with us. We are not affiliated with, do not represent, and are not endorsed by the lenders we list unless we say so explicitly. If we ever accept payment for a listing, we will label it as sponsored. Figures shown are indicative — confirm them directly with the lender.

How we are compensated

We are paid by buyers of our data and reports — a one-time fee per dataset or report, charged through our third-party payment processor (Stripe). There is no subscription, no commission, and no fee that varies with the size or terms of any loan, property, or transaction. We hold no interest in whether you transact, lend, or buy anything as a result of the data.

No professional advice

Nothing on this site — the data, the reports, the calculators, the directory, the guides, or any communication from us — is legal, tax, accounting, investment, or financial advice, and none of it should be relied on as such. Consult your own attorney, accountant, and advisors before entering into any financing or transaction.

Operating entity

Provenance Capital is a brand operated by KUROGIRI LLC, a New York limited liability company. KUROGIRI LLCis registered with the New York Department of State (DOS ID 7648243). “Provenance Capital” is a brand and trade name; it is not a separate legal entity, and it is not a registered or licensed financial institution.
